BYBIEHL DATA PROTECTION POLICY

  1. Why do we need your personal information?

BYBIEHL uses information from our interactions with you and other customers as well as certain third parties as a means to achieve our goal of providing products and services of the highest quality.

BYBIEHL respects the privacy of our online visitors and recognizes the importance of protecting the information collected about them. Therefore, we have established procedures to ensure that your personal information is processed fairly.

This data protection policy informs you about the type of material we collect and how; the purposes for which we collect and use it; your rights and choices regarding the use of your data; how your data is processed and with whom it may be shared; and how long we store your information, etc. Please read the text carefully.

DEFINITIONS:

All our activities are based on strict ethical principles and legal requirements, and we are committed to protecting the privacy of all visitors to our websites and users of our (mobile) applications. Therefore, the way we collect and store information, including personal data, depends on how our website and related services are used. We do not collect any sensitive data about you.

3.1 Data collected through your interaction with us

Various technologies may be used on our websites and our (mobile) applications with the aim of improving them, making them more user-friendly, efficient and secure. Such technologies may result in personal data being collected automatically by us or by third parties on our behalf. Examples of such technologies include cookies, flash cookies and web analytics. In connection with the purposes mentioned in sections 5.2 below, certain personal data may be collected via cookies if you have given separate consent to this. In such case, the legal basis for the processing of your personal data is your consent, cf. Article 6(1)(a) of the General Data Protection Regulation. We may collect information about your computer for system administration purposes and to compile reports with aggregated information for internal marketing analysis purposes. This is information about our users' browsing behavior and may include the following:

3.1.3 Retargeting technologies

Information provided by you when you created a wish list or saved your sizes, designs, your favorite stores or lists of your jewelry. Information you provide when you participate in a competition or promotion sponsored by BYBIEHL. Information you provide to us through third parties such as Facebook and Instagram. Information you upload to or share through our site when you use our services. If you have created an online account with us: the preferences and interests stored under this profile (further information about these profiles is provided below). If you contact us, we may keep a record of our correspondence. If you contact us to report a problem with our site or to obtain technical help and/or customer support, we may keep a record of the correspondence or conversation with you. If we choose to participate in an alternative dispute resolution via the online dispute resolution platform, we may disclose personal data to the European Commission in its capacity as operator of this platform and to any alternative dispute resolution provider appointed to handle the dispute. We may ask you to complete questionnaires that we use for research purposes, although you are not obliged to answer them. All this data is characterised by the fact that you have provided it voluntarily. We use this information for the purposes described in this data protection policy. You can change your personal data or object to its continued processing at any time (see section 7).

Now that you have registered to create a BYBIEHL account, we may process your personal data in the following ways:

To ensure that content on our site is presented to your computer in the most effective way possible.
For purposes related to your order; for example, to notify you of the status of your order or delivery; to comply with your requests such as answering a question about our products; to help you find a store near you; to fulfill your order; to process your payment by card and/or provide customer service to you. We may use your data to assess your creditworthiness, which may involve the use of third parties.
To verify your identity and to respond to any inquiries you may have about us; to process your inquiry and provide you with the best possible service. To comply with obligations arising from contracts entered into between you and us. To allow you to participate in the interactive features of our service(s) that you may wish to participate in. To allow you to send emails to others via our “send to a friend” feature. To allow you to participate in sweepstakes, competitions and similar promotions and to administer such activities. Some of these activities have additional rules that may contain additional information about how we use and disclose personal information. Tailor your content on our websites so that you receive personalized offers. Prevent and/or detect abuse or fraud. With your permission, we may contact you directly using the information you have provided (e.g. via postal services, email, text messages, telephone or other electronic means) for marketing, advertising and market research purposes. This includes, for example, information related to BYBIEHL products, e-commerce activities, special offers and promotions, as well as information about local store openings and activities. In order to contact you with information of particular interest to you, your general interaction with BYBIEHL (such as, but not limited to, your shopping behavior in our online shop and in physical BYBIEHL stores; your use of loyalty programs; your ratings and reviews of products; your contact history with our customer service; your clicks on / opens of newsletters; your surfing behavior (web tracking); the types of newsletters you subscribe to; your participation in campaigns or events; your interactions with and use of mobile applications) will be analyzed and used collectively. We may use your personal data for marketing, advertising and market analysis purposes. 5.1 When you purchase an item from our online shop, create an account with us or enter into an agreement with us, we will process your general personal data for that specific purpose. We may also process your general personal data if, for example, you have an enquiry or similar that precedes the conclusion of an agreement with us. The legal basis on which we may process your personal data is set out in Article 6(1)(b) of the EU General Data Protection Regulation (EU) 2016/679 (GDPR), as the processing of your personal data is necessary for us to fulfil our agreement with you or to handle your enquiries or similar before entering into an agreement.

We may also process your general personal data on the basis of the rules in GDPR Article 6(1)(f). We have a legitimate interest in processing your personal data (name and email address) for both marketing and analytical purposes. Our legitimate interest is based on your preferences, so that we can better tailor offers to you – and ultimately offer you products and services that better meet your needs and wishes. In addition, we have a legitimate interest in processing your personal data for analytical purposes.

5.2 Surveys, statistics and analyses of your use of our platforms.
The legal basis for the processing is our legitimate interest in improving our products and services, including our website and app, cf. Article 6(1)(f) of the General Data Protection Regulation.

  1. Disclosure of personal data

Treating your data with the utmost care and confidentiality is one of our core values. If required by law, your data may be transferred to third parties. We use service providers and data processors who process data on our behalf. These services include authentication, hosting and maintenance services, analysis services, email sending services, distribution services, payment transaction processing, solvency, address and email verification. These third parties are our data processors and they will only process personal data to the extent necessary to provide their services. Our data processors are contractually obliged to treat such data with the utmost confidentiality. They are prohibited from using the data in ways other than those required. Necessary steps are taken to ensure that our data processors, including service providers and other processors working on behalf of BYBIEHL, maintain and protect the confidentiality of your data.

Some of our data processors are located outside the EU/EEA. This means that we will share your personal data with countries outside the EU/EEA. However, we will only make this information available on the condition that the recipient complies with applicable requirements, including:

The country in question is considered a safe third country.
The supplier in question must adhere to the European Commission's standard contractual clauses for the transfer of personal data to third countries. The supplier in question is certified in accordance with Art. 40 of the GDPR; orThe supplier in question has a set of approved binding corporate rules. There may be cases where we disclose non-personal information in an anonymous form to our partners. Please note that the information you publish or disclose through your interaction with BYBIEHL (e.g. personal information contained in photos, stories, comments and videos that you submit) will become public information and may be available to visitors to the site and the general public.

We may disclose your information to the extent that we are required to disclose or share your personal information to comply with legal obligations or directives from the court or other competent legal body, or to enforce or apply our data protection policy and other agreements; or to protect the rights, property or safety of BYBIEHL Denmark ApS, our employees, customers or others. If you provide us with personal data on our websites or in other channels, this is done on a completely voluntary basis. If you choose not to provide the requested information, there may be various customer benefits to which you will not have access. In some cases, only those individuals who have provided the required personal data can order products, use certain services and otherwise benefit from the activities and offers available on our website and (mobile) applications. 7.1 The right to request access to your personal data

You have the right to access some of the personal data you provide to BYBIEHL. By contacting us via mail@byBiehl.com you can request information about the information about you that we store and process, including the purpose for which it is used.

You can also access your personal information by logging into your BYBIEHL account at www.byBiehl.com and entering your account profile information. Click on “My Profile” or “My Account” to access your personal information.

7.2 The right to change and/or delete your personal data

You have the right to request correction, completion, deletion or blocking of your stored personal data. You can do this by writing to mail@byBiehl.com. If we do not receive your request too late, we will comply with it as requested. If for one reason or another we cannot comply with your request, we will contact you.

7.3 The right to restrict the processing of your personal data

Under special circumstances, you have the right to restrict the processing of your personal data. You can request such restriction by writing to: mail@byBiehl.com

7.4 Right to data portability

You have the right to receive your personal data (which concerns you only) in a structured, commonly used and machine-readable format (“data portability”) and the right to transmit these data to another data controller. You can request data portability by writing to: mail@byBiehl.com

7.5 Right to object to the processing of your personal data and to opt out

You have the right to ask us not to process your personal data when the processing is based on a legitimate interest pursued by BYBIEHL, e.g. for marketing purposes. We will inform you in this data protection policy if we intend to use your data for such purposes or to disclose your data to third parties for such purposes. You can always exercise your right to object by sending an e-mail to mail@byBiehl.com or a letter to the postal address at the end of this document.

Emails containing newsletters or marketing content that BYBIEHL sends to you include an option to unsubscribe by following the instructions in the email. If you do not wish to receive emails from us, you can simply click on the unsubscribe hyperlink and we will stop sending you emails.

For all other types of messages you may receive from us, such as maintenance messages or administrative notifications, the receipt can only be stopped by deleting your account. These messages are a mandatory part of user accounts and the related use of our websites and (mobile) applications. Please contact mail@byBiehl.com if you wish to delete your account.

7.6 Right to withdraw your consent at any time

You have the right to withdraw your consent to the processing of your personal data at any time. However, this will not affect the lawfulness of the processing based on the consent before this withdrawal. Please contact us via mail@byBiehl.com if you wish to withdraw your consent.

If you wish to withdraw your consent to receive promotional information and general offers, including information via postal services, e-mail, text messages, telephone or other electronic means, you can do so at any time by writing to BYBIEHL Group, Data Protection or sending an e-mail to mail@byBiehl.com. If we have concerns about your identity, we may ask you to provide identification.

7.8 Conditions and/or limitations of your rights

There may be conditions or limitations to your aforementioned rights. We cannot therefore guarantee you the right to data portability as this depends on the specific circumstances of the data processing.

BYBIEHL will not store your personal data for longer than is necessary in relation to the purposes for which they are processed.

We take appropriate technical and organizational measures to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorized use, disclosure or access, in particular where the processing involves the transmission of data over a network, as well as against all other forms of unlawful processing and misuse.

BYBIEHL uses third-party data processors to collect and process your personal data. All data processors appointed by BYBIEHL will only process your personal data in accordance with BYBIEHL's instructions and are legally obliged to adhere to strict security procedures in the handling of personal data.

9.1 Protection of information

BYBIEHL may use third parties to collect personal data on its behalf. In such cases, these third parties will be subject to confidentiality and data processing agreements, and BYBIEHL will instruct them on how to fully comply with BYBIEHL's data protection policy.

To the extent that we have given you, or you have chosen, a password that allows you to access certain parts of our site, you are responsible for ensuring that this password is kept confidential. We ask that you not share your password with anyone.

Unfortunately, the transmission of information over the Internet is not completely secure. Although we do our utmost to protect your personal information, we cannot guarantee the security of your data transmitted to our site. Any data transmission is therefore at your own risk. Once we have received your information, we apply strict procedures and security measures in an effort to prevent unauthorized access.

9.2 Social networks

Our website and (mobile) applications make so-called social plug-ins from various social networks available to you. If you choose to interact with a social network, your activity on our website or (mobile) applications will also be available to social networks such as Facebook and Twitter.

If you are logged in to one of these social networking sites during your visit to one of our websites or (mobile) applications, the social network may add this information to your profile. 9.3 Geolocation Services

Location-based services may be used as part of some of our (mobile) applications. If you use these (mobile) applications, they may receive information about your current location, such as GPS signals sent by a mobile device or information that can be used to approach a location. You can enable or disable your location services in your device or browser settings.

We use Google Maps to help you find your nearest BYBIEHL store. To facilitate this search, we load an image from Google Maps and store route data and the map image on our server.
